The brief
What clients ask us
Choose a question. The answer sets out the work we actually take in this practice, in plain language.
Answer
Yes. The personal law that applies, and the Special Marriage Act where that is the marriage, decide the ground and the procedure. Distance changes the logistics. It does not remove the need for a proper petition.
- Contested divorce and divorce by mutual consent
- Petitions under the relevant personal law
- Petitions under the Special Marriage Act
- Divorce proceedings for non-resident Indians

How do you approach custody and visitation?
Answer
The question the court asks is the child's welfare, not which parent wants the longer schedule. We prepare the case on that basis, including where the child is in another country.
- Custody and visitation
- Schedules that a court can actually supervise
- Inter-country custody disputes involving NRIs
What about maintenance, alimony, and property?
Answer
Money claims in a matrimonial case have to be proved, enforced, and sometimes changed when circumstances change. Property is divided on the facts of that marriage, not on a fixed percentage.
- Alimony and maintenance, including enforcement
- Modification when circumstances have changed
- Division of property in the matrimonial dispute
Can you help in a domestic violence case?
Answer
Yes. We act for the person seeking protection, and for the person who says the allegation is false. The orders available are specific, and they should be asked for in specific terms.
- Complaints under the domestic violence law
- Protection orders, residence orders, and monetary relief
- Defence where the allegation is said to be false
Do you advise on adoption, guardianship, and agreements?
Answer
Not every family instruction is a divorce. Some are about a child's legal status, a separation that is not yet a divorce, or an agreement the couple wants in writing.
- Domestic and inter-country adoption
- Guardianship of a minor
- Legal separation and separation agreements
- Prenuptial and postnuptial agreements
- Paternity
The path
How a matter moves
01
Which law applies
Marriage, personal law, and where each spouse lives decide the petition and the court.
02
What must be protected now
Residence, maintenance, or a child's schedule is dealt with before the final hearing.
03
Settlement or evidence
Where consent is real, terms are written. Where it is not, the case is proved.
04
The order, made to work
A decree or a protection order is enforced, and modified if life has changed around it.

Questions on this practice
Can a divorce be filed if my spouse lives outside India?
Yes. Service, evidence, and custody become more elaborate. They are manageable if the petition is framed for that from the start.
Is a mutual consent divorce always faster?
It is faster when both people will sign, wait out the statutory period, and not reopen the terms. If consent is likely to collapse, a contested petition should be ready.
Can maintenance be changed later?
Yes, when circumstances have genuinely changed. The application has to show that change. It is not a second attempt at the original case.
Will a child's preference decide custody?
The court hears it. The decision remains the child's welfare. We prepare the case around schooling, care, and stability, not around a slogan.
Do you draft agreements before a marriage?
Yes. A prenuptial or postnuptial agreement is drafted so that a court can read it later, not only so that the couple can sign it now.
